This Agreement contains the terms and conditions that apply to online purchases by Consumers (“Customer”) from BatPak (“BatPak”). These terms and conditions will govern all orders for BatPak products sold in the United States from our website. By accepting delivery of the products described on a BatPak invoice or shipping statement, Customer agrees to be bound by and accepts these terms and conditions. These terms and conditions are subject to change for future sales or deliveries without prior written notice at any time, in BatPak’s sole discretion.

 

Product Description: BatPak introduces a groundbreaking product designed to empower users to independently tackle bat evictions in their homes. Our product is built on the core principles of ease of use, safety, and ethical treatment of bats, offering homeowners a reliable solution for DIY bat eviction.

 

Product Warnings:

1. Metal Flashing: This product can cut you. Use caution when handling and cutting. Wear safety glasses and leather gloves. Remove all aluminum trimmings from job site. Follow all tool and ladder manufacturers' instructions and safety recommendations. Keep a clear distance between electrical power lines, ladders and this product.
2. Closed Cell Foam: Danger: flammable. Contents under pressure. Pressurized can: mishandling and improper storage may cause rupture. Do not puncture or incinerate. Do not expose can to temp over) 120°F (49°C). Container may rupture if heated, keep away from heat, sparks, and open flame, do not smoke, extinguish all flames and pilot lights, and turn off stoves, heaters, electric motors, and other sources of ignition during use and until all vapors are gone. Keep away from children and pets. Use ventilation or proper respiratory protection. Avoid inhalation, skin contact, and eye contact; may cause sensitization. Extremely sticky. Protect eyes, skin, surfaces application: cured foam is combustible and may present a fire hazard if exposed to flame or temperatures above 240° (116°C).First aid: consult a physician (show label when possible). Eye: flush with water for 15 minutes. Skin: soak in soap and water. Inhalation: move person to fresh air. Ingestion: give fluids. Do not induce vomiting. Contents: polymeric diisocyanate 9016-87-9, polyurethane prepolymers 57029-46-6 & 53862-89-8, isobutane 75-28-5, propane 74-98-6 and dimethyl ether 115-10-6. VOC <16wr% HFC free. Refer to safety data sheet.
3. Hardware Cloth: Warning: wear safety glasses and use extreme care when handling to avoid possible injury. May be harmful if eaten or chewed. May generate dust containing lead. Wash hands after use. Keep out of reach of children. Warning: this product can expose you to chemicals including lead, which is known to the state of California to cause cancer and birth defects or other reproductive harm. 4. BatSeal: Warning: causes skin irritation. Causes serious eye irritation. May cause allergic skin reaction. Precautionary statements: wash face, hands and any exposed skin thoroughly after handling. Avoid breathing dust/fume/ gas/mist/vapors/spray. Contaminated work clothes must not be allowed out of the workplace. Wear protective gloves/protective clothing eye protection/ face protection. Store in a dry place. Store locked up. Dispose of contents/ container in accordance with the local/regional/national/international regulations. For additional information, consult SDS for this product. First aid: eye contact: rinse cautiously with water for several minutes. Remove contact lenses, if present and easy to do. Continue rinsing. If eye irritation persists: get medical advice/attention. Skin contact: wash with plenty of soap and water. Take off contaminated clothing and wash it before reuse. If skin irritation or rash occurs: get medical advice/attention. Inhalation: remove to fresh air. Ingestion: clean mouth with water and drink plenty of water afterwards.
5. Exterior screws: Warning: this product can cut you. Wear safety glasses and use extreme care when handling to avoid possible injury. May be harmful if eaten or chewed. Keep out of reach of children to prevent choking hazard.

  

User Responsibilities: By using BatPak products, users acknowledge their responsibility to adhere to all safety guidelines provided. Users are solely responsible for the proper and ethical use of BatPak products, ensuring that bats are treated humanely and in accordance with local regulations.

 

Limitation of Liability: While BatPak strives to provide effective solutions, users understand and accept that bat eviction can vary depending on factors beyond our control, such as the severity of infestation and environmental conditions. BatPak shall not be liable for any damages, including but not limited to property damage or personal injury, arising from the use of our products, except where prohibited by law.

 

Warranty: BatPak offers a limited warranty covering defects in materials and workmanship for a period of one month from the date of purchase under normal usage conditions. This warranty excludes damages caused by improper use, negligence, or unauthorized alterations to the product. Additionally, opening and utilizing sealant or foam products for installation purposes will void the warranty.

 

Returns:

1. Return Window: Customers can return the BatPak kits within 30 days of the original purchase date.
2. Condition for Return: Items must be returned in their original packaging, unused, and in the same condition that they were received. Please ensure all components are included.

5. Prepare Your Package: Pack the BatPak kit securely in its original packaging. Include all items that were originally shipped to you. Write the RMA number clearly on the outside of the box.
6. Ship the Package: Send the package to the return address provided by our customer service. Customers are responsible for return shipping costs. We recommend using a trackable shipping service to ensure the package reaches us.

 

Eligibility for Refund:Customers are eligible for a refund, excluding shipping costs, if the BatPak kits are returned within the 30-day return window, under the conditions specified.

 

Condition for Refund:To qualify for a full refund, excluding shipping costs, the returned items must:

 

1. Be returned within 30 days of the original purchase date.
2. Be in their original packaging, unused, and in the same condition as they were received.
3. Include all original, unopened components.

 

Indemnification: Users agree to indemnify and hold harmless BatPak and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or in connection with the use of our products.
